Can a Utility Company Access Your Backyard?
Imagine a cable company knocks on your door and says they need access to your backyard to install new fiber-optic cables.
You tell them it’s private property.
They tell you, “There’s an easement on your property.”
So… what does that actually mean?
What is an easement?
An easement means that even though you own the property, someone else may have the right to use or access a certain part of it.
A common example is a utility easement.
Your property may have an area where electric, gas, water, cable, or other utility companies are allowed access to install or maintain their equipment.
Can they just enter your backyard?
Not necessarily.
An easement doesn’t automatically give someone access to your entire property. It depends on where the easement is and what it allows them to do.
If a company says they have access through an easement, you can ask them where the easement is located and what gives them the right to access it.
How do you know if your property has one?
You might not know just by looking at your yard.
Easements can often be found in your title report or recorded property documents. A property survey can also help show exactly where one is located.
Is having an easement a bad thing?
Not necessarily! Easements are actually pretty common.
Having one doesn’t automatically mean there’s a problem with your property. It’s simply important to know where it is and what it’s used for.
This can be especially helpful if you’re planning to build a pool, ADU, garage, fence, or addition, since an easement could affect where you can build.
The important thing isn’t to be worried about an easement — it’s to know if you have one and understand what it means for your property.
